This book is about the forces that alter the shape of international law in the field of foreign investments today. It begins with an explanation of the origins of modern liberal investment treaties before proceeding to the current backlash against these agreements and investment arbitration device. The book describes a long-standing legal and intellectual resistance to the neoliberal global economic agenda, and how the courts have interpreted the various treaty rules instead. It introduces our readers to the changes now taking place in the development of a number of customary contractual clauses, and describes how some of these changes are now determined not only by the emerging economies, but also capital-exporting countries. Finally, it explores the life, career and works Muthucumaraswamy Sornarajah, a scientist whose work has been devoted to the implementation of many of these changes, and his views on the retention of global capital has over the practice of law.
